Nebraska recently joined the many states that have adopted a duty that lawyers must be technologically competent.  It is very likely that soon all states will have a technology competence requirement for lawyers.  This brief  article discusses this duty, and contains links to discussions about the other states that have adopted it.

The Nebraska Supreme Court adopted the amendment on June 28, 2017. It amends comment 6 to Nebraska Rule of Professional Conduct § 3-501.1 — the corollary to ABA Model Rule 1.1 on competence — to read as follows:

To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology, engage in continuing study and education and comply with all continuing legal education requirements to which the lawyer is subject.
